Learned counsel for the petitioner at the very outset submits that the impugned order at Annexure -"2" dated 06.02.2020 is appealable before the Divisional Commissioner, Tirhut Division as such, he seeks permission to withdraw this application with liberty to the petitioner to prefer appeal before the appellate authority i.e. Divisional Commissioner, Tirhut Division.

Learned counsel for the State has got no objection.

Patna High Court CWJC No.5971 of 2020(2) dt.12-07-2021 2/2 Permission is granted.

Accordingly, this writ application is dismissed as withdrawn with the aforesaid liberty.

It is made clear that if appeal is filed by the petitioner within a period of four weeks from today along with petition for condonation of delay, the same shall be considered by the appellate authority in accordance with law.
