The petitioner seeks bail in connection with Special Case No. 4190 of 2021 arising out of Shastri Nagar P.S. Case No. 251 of 2021 dated 10.07.2021 instituted for the offences under Sections 30(a) & 56 of the Bihar Prohibition & Excise Act.

The petitioner is sought to be prosecuted in this case on the basis of confession made by one Dharmendra Kumar who was arrested in this case on suspicion.

In the aforesaid case, approximately 1192.320 liters of liquor has been recovered from a hut and a vehicle. The petitioner was earlier made accused in two cases

No.20798 of 2022(2) dt.26-05-2022 2/2 about which clear reference has been given in para-3 of the bail petition but, at the time of argument, the learned counsel for the petitioner informs that after the petitioner was arrested in the present case, he was remanded in another case and, therefore, the reference of the third case could not be given in this petition. The petitioner is in custody since 25.02.2022. Regard being had to the nature of accusation and the period of custody, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna in connection with Special Case No.4190 of 2021 arising out of Shastri Nagar P.S. Case No. 251 of 2021.
