JUSTICE SANJAY PRIYA ORAL ORDER 02-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 47A, 57 of the Bihar Excise (Amendment) Act, 2016.
It has been submitted that the petitioner was not caught on the spot. The alleged country made liquor has been recovered from the house of one Sandip Kumar. The seizure list has been enclosed with the written report in which it is also mentioned that the seizure was made in the house of one Ravindra Yadav from where the alleged country made liquor has been recovered.
In the written report itself it is mentioned that the petitioner was not caught on the spot and her name was disclosed

Considering the aforesaid facts and circumstances of the case as also the petitioner being a lady, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Gopalganj Town P.S. Case No. 306 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
