JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(i-b)a/26/35 of the Arms Act.

Petitioner was caught red handed, while he was fleeing after committing loot. The looted articles, stolen motorcycle and country-made Katta are said to have been recovered from conscious possession of the petitioner. The petitioner is languishing in jail custody since 13-05-2015 but taking into account facts and circumstances of the case as well as criminal antecedent of the petitioner, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Baikunthpur P.S. Case No. 85 of 2015 stands rejected.
