ANJANA MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Katihar Town/Sahayak P.S. Case No.815 of 2018 for allegedly having committed the offence under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the allegation is of having committed theft in the house of the informant, despite two raids in her house, there has been no recovery from her possession of any stolen article. Learned counsel for the petitioner further submits that the alleged recovery of stolen mobile is also false and concocted and has been saddled on her shoulder. It is further submitted that the petitioner has no criminal antecedent and she had been working

Patna High Court CR. MISC. No.18737 of 2019(3) dt.22-05-2019 2/2 in the area where several Judicial Officers are residing without there being any allegation from any quarter as she has earned reputation of her honesty.

Considering the aforementioned facts and circumstances and that there is no criminal antecedents, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town/Sahayak P.S. Case No.815 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
