2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) , 30 ( D ) of Bihar Prohibition and Excise Act.
3 . It is alleged that 15 liter country made wine has been recovered from two plastic Jarkin from bush in front of house of co-accused Dulha Mushar and this petitioner is alleged to have fled away from the spot.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way
Patna High Court CR. MISC. No.21286 of 2025(2) dt.23-04-2025 2/2 connected with the aforesaid recovery . Petitioner has got 1 criminal antecedent of similar nature in which is on bail. 5 . Learned counsel for the State opposes the bail petition .
6. Considering the fact that only suspicion has been raised against this petitioner and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned special Excise Court No. 2 at Buxar in connection with Murar Police Station Case No. 84 of 2023 subject to the conditions laid down under section 438 ( 2 ) of Code of Criminal Procdeure .
