Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 30(a) of Bihar Prohibition Excise Act 2016 and amendment act 2022.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and an allegation is of recovery of 330 litres of liquor along with country-made pistol and cartridges from the petitioner.

It is next submitted that petitioner is in custody since 30-11-2023 and charge-sheet has been submitted in the case.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Pribahore P.S. Case No. 858 of 2023. 7.
One of the bailors of the petitioner shall be his elder brother, Akhilesh Kumar.
