JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Siwan Town P.S. Case No. 444 of 2018 registered for the offences punishable under Sections 366, 366A, 370 and 34 of the Indian Penal Code.

Allegation against the petitioner as per complaint petition, which was later on registered as FIR, is that petitioner in conspiracy with others took all the certificates of the daughter of the complainant on the pretext of her medical training and also prepared paper of marriage.

Submission of learned counsel for the petitioner is that he is son-in-law of elder brother of the complainantinformant and he has also lodged a complaint against the informant and others after the present complaint case is filed.

Patna High Court CR. MISC. No.18791 of 2019(5) dt.12-07-2019 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail stating that the victim has supported the allegation in her statement under Section 164 Cr.P.C. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
