The sole petitioner who is in custody since 1.6.2016 in Kurhani P.S. Case No. 158 of 2016 registered for the offence under section 304 of the Indian Penal Code has prayed for grant of bail.

Learned counsel for the petitioner by way of referring to the F.I.R. submits that from the F.I.R. it is evident that informant himself had requested the petitioner for providing some medical aid. He submits that after treatment while the wife of the informant was being carried to hospital she died. Besides hearing, I have also perused the F.I.R. and materials available on record. It is a case under section 304 of the

Patna High Court Cr.Misc. No.34555 of 2016 (2) dt.20-08-2016 2/2 Indian Penal Code.

In view of nature of accusation, let the petitioner Shiv Nath Ram be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sri Manish Pandey , learned Judicial Magistrate Ist Class, Muzaffarpur / concerned court in connection with Kurhani (Turki O.P. ) P.S. Case No. 158 of 2016. (Rakesh Kumar, J) Praful/- U T
