JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but in course of investigation, it came to light that victim used to recharge her mobile at the shop of the petitioner and she used to talk with the petitioner. It also came to light in course of investigation that the deceased also used to talk with one Amresh Kumar Singh and one or two days prior to the alleged occurrence, deceased had gone to the shop of the petitioner, where she disclosed that she has solemnized her marriage, which is evident from perusal of Para-51 of the case diary, in which statement of one Kanahi Singh, who happens to the employee of the petitioner, has been recorded. Patna High Court Cr.Misc. No.33858 of 2016 (3) dt.25-10-2016 2/2 co-accused confessed this fact that deceased had come to Muzaffarpur along with him and, after that, she started residing with him having solemnized her marriage with him. Moreover, the aforesaid co-accused also disclosed that, later on, she was handed over to her parents.

Submission on behalf of the petitioner is that, as a matter of fact, deceased solemnized her love marriage with coaccused Amresh Kumar Singh but, subsequently, she returned to her parents' house, where she was killed by her parents. Considering the aforesaid facts and circumstances as well taking note of this fact that investigation against the petitioner has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S.Case No. 73 of 2016.
