JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 409, 420/34 of the Indian Penal Code.
Petitioner was working as Panchayat Secretary at the relevant time and it is alleged that petitioner and other accused purchased solar lights from an unauthorized company violating the rules and guidelines issued by the Government. Submission on behalf of the petitioner is that the Government issued guidelines in the year 2010 and directed the authorities to purchase solar light from BREDA but the purchase of the present case was made in the year 2007. No.33109 of 2016 (3) dt.19-08-2016 2/2 submitted that it was concerned Mukhiya who had purchased the solar lights and the aforesaid Mukhiya has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 57831 of 2015 whereas petitioner is languishing in jail custody since 01.06.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dhansoi P.S. Case No. 122 of 2014.
