The petitioner is accused in connection with Complaint Case No. 89 of 2016 registered under Sections 47(A) and 53(C) of the Excise Act.

The accusation is of recovery of 20 litres of Tari from possession of the petitioner.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that out of 20 litres, 19 litres Tari was damaged in course of raid whereas only one liter Tari was seized. It is further submitted petitioner has no criminal antecedent and is in custody since 07.04.2016.

No.27870 of 2016 (2) dt.14-07-2016 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, (West) Muzaffarpur, in connection with Complaint Case No. 89 of 2016.
