2. The petitioner apprehends his arrest in a case registered for offence under Sections 406, 409, 420, 120(B)/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that though, as per F.I.R., this petitioner alongwith other co-accused persons defalcated the amount of the informant, but during investigation, it was found by C.S.P. Company that some irregular amount automatically deducted from the account of customer, then the bank, through the CSP, returned back the amount into the account of informant and others. He further submits that the informant, after realizing the fact that the accused person has no hand in the alleged transaction, the informant entered into a compromise with co-accused Sunil

Patna High Court CR. MISC. No.24973 of 2024(2) dt.27-03-2024 2/2 Yadav in the Court below (Annexure P/2). Co-accused Sunil Yadav has already been granted anticipatory bail by this Court, vide order dated 05.01.2024 passed in Cr.Misc. No. 80250 of 2023 (Annexure P/4). Petitioner has got clean antecedent.

4. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XI, Bhagalpur in connection with Pirpainti P.S. Case No. 48 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
