JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-01-2023 This writ petition has been filed for issuance of direction to respondents Nos. 1 to 4 to pay the petitioner the difference amount of his salary for the period 19.09.2013 to 31.12.2023 after granting him the pay-scale prescribed for the post of Plumber Helper i.e., the pay-scale of Rs. 775-Rs. 12-Rs. 995-Rs. 12-Rs. 1025 on account of regularisation of his services against the said post in the work charged establishment of the respondent- Bihar State Housing Board with effect from 19.09.1990 in terms of the Hon'ble Supreme Court's order dated 13.02.1991 passed in Civil Appeal No. 766 of 1991 in compliance to which the Board formally issued office order vide

Patna High Court CWJC No.18802 of 2014(2) dt.10-01-2023 2/2 Memo No. 1631, Patna dated 08.05.2002 regularising the services of the petitioner and other identically placed. It is submitted on behalf of the petitioner that the case of the petitioner is fully covered by a judgment dated 04.02.2017 passed in C.W.J.C. No. 15731 of 2012 as well as order dated 02.09.2022 passed in C.W.J.C No. 10472 of 2021 by co-ordinate Bench of this Court.

Learned counsel for the respondents does not dispute the fact that the case of the petitioner is covered by the aforesaid judgment.

Taking into consideration the aforesaid facts, this writ petition is disposed of in terms of order and judgment passed in C.W.J.C No. 10472 of 2021 and C.W.J.C. No. 15731 of 2012 respectively. The respondents shall take a decision on the petitioner's claim by a reasoned and speaking order. Dues found due and admissible should also be paid to the petitioner. Let the exercise be completed by the respondents within a period of eight weeks from the date of receipt/production of a copy of this order.
