The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.

The accusation against the petitioner is that he failed to handover 37 measurement books after being dismissed form the post of Junior Engineer.

It is submitted by learned counsel for the petitioner that the petitioner has handed over the entire charge, though, subsequent to the lodging of the FIR. In the circumstances, let the above named petitioner be released on anticipatory bail provisionally for three

No.34597 of 2015 (2) dt.25-08-2015 2/2 months in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 154 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below on submission of the proof suggesting handing over the complete charge by the petitioner otherwise the petitioner will surrender and pray for regular bail.
