2. The petitioner seeks regular bail in the present case registered for the offence under Sections 302, 201 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, allegation against the petitioner is of entering into conspiracy to kill her husband.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.26378 of 2024(7) dt.17-01-2025 2/2 petitioner is innocent and has not committed any offence. The petitioner has two children aged about 2 years and 3 1⁄2 years and is in custody since 28.09.2023.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the facts that the petitioner has two children and also considering the period of custody, this application for grant of regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of A.C.J.M., 10th Gaya /concerned Court below in connection with Fatehpur P.S. Case No. 710 of 2023.
