The petitioner seeks bail in Jamui P.S. case No. 211 of 2018 registered under Section 302/34 of the Indian Penal Code. The informant alleged that a marriage ceremony was going on but generator was switched off at about 10.30. His cousin, Awadhesh Singh, found Pramod Yadav standing near the generator. Awadhesh Singh ran after Pramod Yadav on such the petitioner is alleged to have assaulted Awadhesh Singh with Lathi. It is further alleged that Hriday Lal Yadav assaulted his father with a big stone on his head and father of informant died while being taken to the hospital.
The learned counsel for the petitioner is alleged to have assaulted Awadhesh Singh but Awadhesh Singh did not get
Patna High Court Cr.Misc. No.58671 of 2018 (2) dt.20-09-2018 2/2 any injury. The petitioner is not the assailant of the deceased. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is not the assailant of the deceased, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. case No. 211 of 2018.
