JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-06-2019 Heard learned counsel for the petitioners, learned counsel for the informant as well as learned APP. Both the parties are close relatives. The allegation is at the end of OP No.2/complainant regarding misappropriation of Rs. 60,000/-.

Learned counsel for the petitioners has submitted that petitioner no.2 who is the maternal uncle of the OP No.2 is ready to deposit the amount though, this case has been filed purposely, intentionally under coercive methodology as, the negotiation to purchase the land having at the instance of petitioner no.2 failed on one pretext or the other and for that, Annexure-3 has been filed, in order to save their prestige.

Madan Gopal Prasad, in the event of arrest/surrender within four weeks from the date of order, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two securities of the like amount each to the satisfaction of Sub-Judge-XIV-cumAdditional Chief Judicial Magistrate, Patna in connection with Complaint Case No. 27830(C) of 2014, subject to the condition as laid down under Section 438(2) of the CrPC.
