JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 25.06.2021 and has antecedent of three cases.
The informant alleges that he had gone to Amnaur to purchase vegetables and had parked his motorcycle and when he came back his motorcycle was missing.
Learned counsel submits that petitioner has been falsely implicated in the present case, it is next submitted that for the same occurrence two cases were instituted that is the
Patna High Court CR. MISC. No.20805 of 2022(4) dt.06-01-2023 2/2 present one and Amnaur P.S. Case No. 85 of 2021. Learned counsel next submits that petitioner is on bail in Amnour P.S. Case No. 85 of 2021, it is next submitted that in Amnour P.S. Case No. 85 of 2021, the alleged motorcycle is said to have been recovered from possession of the petitioner in which he is on bail and for the same offence the present FIR has been instituted.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Amnour P.S. Case No. 84 of 2021. One of the bailor shall be the father of the petitioner, namely, Ram Jeevan Manjhi.
