The petitioner apprehends his arrest in connection with Daudpur P. S. Case No. 122 of 2016 instituted under Sections 414/34 of the Indian Penal Code and Sections 47 and 57 of the Bihar Excise Amendment Act, 2016.

The allegation, in brief, is that the police apprehended a motorcyclist and recovered foreign liquor, in total 8.64 litres from his possession and he disclosed that the motorcycle was of this petitioner.

Learned counsel for the petitioner submits that the petitioner, at the request of Jitendra Kumar, who lives nearby his village, gave his motorcycle for his personal use. It appears that the motor cycle was used by Jitendra

Patna High Court Cr.Misc. No.5418 of 2017 (2) dt.06-02-2017 2/2 Kumar for carrying illicit liquor and except use of his motorcycle, there appears no material against this petitioner and he has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, namely, Ajeet Singh @ Guddu, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri M.P.Yadav, Judicial Magistrate, Saran at Chapra in connection with Daudpur P.S.Case No. 122 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
