2. The petitioner is in custody in a case registered for the offence punishable under Sections 140(1), 103 and 238 of the BNS.
3. As per allegation in the FIR, it is a case of abduction of the husband of the informant by the petitioner and other co-accused persons.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner is not named in the FIR and during course of investigation, the police implicated the petitioner only on the basis of that he used the mobile of the deceased with his

No.19429 of 2026(7) dt.16-07-2026 2/3 SIM for two days and on that basis the petitioner has been made accused, the police apprehended the petitioner and got prepared his confessional statement to the effect that he confessed his guilt and such confession of the petitioner before the police is not admissible evidence in the eye of law. Petitioner is in custody since 09.06.2025.
5. Learned APP for the State has opposed the prayer for bail of the petitioner and submits that the petitioner has got one criminal antecedent as stated in para-3 of the petition.

On perusal of the first information report, case diary, postmortem report of the deceased and impugned order dated 21.02.2026, it appears that petitioner and other co-accused persons have committed the murder of husband of the informant by sharp object and he confessed his guilt. From perusal of para4, 6, 7, 16 and 17 of the case diary, it appears that the cause of death of the deceased as stated by the doctor is haemorrhage shock caused by sharp pointed hard object, like, knife stab injury and charge-sheet has already been submitted against the petitioner and several witnesses have supported the case of the prosecution, so I am not inclined to grant regular bail to the petitioner.
7. Accordingly, the prayer for regular bail of the
Patna High Court CR. MISC. No.19429 of 2026(7) dt.16-07-2026 3/3 petitioner is hereby rejected.
However, petitioner is directed to renew his prayer for bail before the learned trial Court after completion of eighteen
(18) months in custody.
