Learned counsel for the petitioner submits that in view of the stand taken by the Respondent Nos. 3 and 4 (Railway) in Paragraph No. 12 of the counter affidavit, the writ petition may be disposed of with a direction to the Railway to do all the construction work only on its acquired land and not beyond it.

3. In view of the aforesaid stand taken by the Railway, it appears that the allegation of the petitioner against Respondent No. 2 for encroaching upon the petitioner's land is
