JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-06-2020 Heard learned counsel appearing for the parties. This bail petition is being taken up for consideration through Video Conferencing.

The petitioner seeks regular bail in a case registered for an offence punishable under section 302 and other allied sections of the Indian Penal Code, section 27 of the Arms Act and sections 13, 16, 19 and 20 of the UAP Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He submits that the petitioner is not named in the FIR and his name has surfaced in the case on the confessional statement of co-accused Hemant Kumar Sahani and Pankaj Kumar during course of investigation. Several co-accused, mentioned in paragraph 9 of the bail petition, have already been allowed bail by different benches of this Court and the case of the petitioner stands on similar footing. Petitioner is in custody since 11.3.2019. Charge sheet has also been submitted in the case.

Learned Addl.P.P. did not controvert the facts. Taking into consideration the facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court CR. MISC. No.18768 of 2020(2) dt.04-06-2020 2/2 furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate X, Vaishali at Hajipur in Patepur Police Station Case No. 224 of 2018 on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bonds shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
