The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 376, 380 and 506/34 of the Indian Penal Code.

The prosecution case is that the husband of the informant went outside the State to earn livelihood when the petitioner being the sister of the informant persuaded her to marry with brother-in-law (Dewar) Md. Istekhar. Subsequently the informant found Rs.6800/- and ornaments missing. Subsequently the informant went to enquire about the money and ornaments then this petitioner gave some intoxicant to her and co-accused Istekhar ravished

It is submitted by learned counsel for the petitioner that for the occurrence of 26.05.2012 the complaint was filed on 02.06.2012 which came to be registered as police case on 05.06.2012.

Considering the delayed lodging of thecase, thrust of accusation against co-accused Md. Istekhar and petitioner being a lady having no criminal antecedent, statement to that effect has been made in paragraph 3 of the petition, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Nalanda at Biharsharif in connection with Soh Sarai P.S. Case No. 83 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
