JUSTICE BIRENDRA KUMAR ORAL ORDER 02-03-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 307, 341, 323 and 324/34 of the Indian Penal Code.
Both sides are family members and for family dispute, petitioner no. 2 Urmila Devi is alleged to have caused injury with fasuli at the head of Vikash, the son of the informant. The Doctor has found two injuries, one of the same was stitched wound on the head of Vikash, simple in nature. Submission of the petitioners is that there is case and counter case. Counter case was lodged before the Sarpanch and in free fight Vikash might have sustained injury due to fall.

Considering the entire facts, specially, the fact that Urmila Devi against whom allegation of assault on the head is a female, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court in connection with Mohania Police Station Case No. 551 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
