The petitioner in the present case is seeking pre-arrest bail in connection with Mehandiganj P.S. Case No.- 143 of 2021 registered for the offences punishable under Sections 323/ 341/ 307/ 504/ 506/ 34 of the Indian Penal Code and Section 27 of the Arms Act. He has got three criminal antecedents.
Learned counsel for the petitioner submits that the informant in her fardbeyan alleged that the elder brother of her husband fired at her which caused injury on her shoulder as she opposed his act of selling smack and ganja.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the petitioner is the brother of the informant's husband and only in the background of family dispute the present case has been lodged.
Patna High Court CR. MISC. No.21001 of 2023(2) dt.24-06-2023 2/2 Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner. It is submitted that this petitioner had fired upon the informant and the bullet hit the back side of shoulder of the informant.
Having regard to the facts and circumstances of the case and considering the nature of allegations saying that this petitioner had fired upon the informant and the bullet hit the back side of shoulder of the informant and further that he had got three criminal antecedents of similar nature, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
