The petitioner is languishing in custody in a case registered for the offences punishable under Sections 376, 493 of the Indian Penal Code.

It is alleged against the petitioner that on promise to marry, he established physical relationship with the informant and when the informant conceived, and put pressure upon the petitioner to marry with her, he denied to marry with the informant.

Patna High Court CR. MISC. No.22554 of 2023(5) dt.19-09-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 2017, F.I.R was registered in the year 2022. Both the petitioner and the informant are major and the relationship, if any, is consensual between the petitioner and the informant. The petitioner is languishing in custody since 14.10.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Gaya in connection with
