Petitioner being the husband of the sister of the informant is languishing in custody since 28.02.2016 in a case registered for the offences punishable under Sections 323, 302, 304, 498A/34 of the Indian Penal Code. The basic accusation is of torture and killing the sister of the informant after nine years of marriage and birth of three children.
It is submitted by the learned counsel for the petitioner that there is no eye witness to the occurrence and the victim was provided medical assistance.
Learned counsel for the State after going through the case diary submits that the children of the victim have supported the accusation of torture and assault. Moreover post-mortem report reflects several injuries.
Patna High Court Cr.Misc. No.29713 of 2016 (3) dt.30-08-2016 Keeping in view of the nature of accusation, this Court is not inclined to grant bail to the petitioner at present in connection with Supaul P.S. Case No. 132 of 2016, pending in the court of learned Additional Chief Judicial Magistrate-III, Supaul.
Accordingly, the bail application is dismissed.
Let, the trial be expedited.
