JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,342,353 and 504 of the Indian Penal Code. The prosecution case is that on 1.7.2015 at about 11 A.M. the villagers of Rasanpur came to the office of the Circle Officer, made enquiry with regard to the construction of road from Parsohda to Rasanpur and blocked the Circle Office, confined some of the employees in a room and obstructed the administration in discharge of official duty. It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.37308 of 2015 (2) dt.15-09-2015 2/2 that the protest was made by general public for not constructing the aforementioned road and in order to conceal their own laches, the officials lodged the present case. It is further submitted that the accusation is against the mob. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Guraru P.S. Case No.55 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
