JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 341, 307, 386, 341, 323, 379 and 427 of the I.P.C. and Section 27 of the Arms Act. The prosecution story, in brief, is that the informant Priya Ranjan Sharma, who is General Manager of Hanumant Construction Private Limited, had given written information to the S.H.O., Hulasganj stating therein that on 25.4.2015 at 10 P.M.
Patna High Court Cr.Misc. No.30475 of 2016 (3) dt.08-09-2016 2/2 of both poplin and also took away mobiles from them. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.2.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has appeared in the present case on the confessional statement of co-accused before the police. No overt act has been alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 5th, Jehanabad in connection with Sessions Trial No.58 of 2016 arising out of Hulasganj P.S. case No.36 of 2015.
