JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Didarganj P.S. Case No. 116 of 2016, registered under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)A, 26,35 of the Arms Act.

The accusation is that in course of patrolling duty, on seeing the Police, some persons started to flee away, but on chase both the petitioners and one Mithilesh Kumar were apprehended by the Police. On search, one country made pistol and three live cartridges were found in possession of petitioner no.1, whereas a country made pistol and a live cartridge was found in possession of petitioner no.2 and a loaded country made

Patna High Court Cr.Misc. No.27895 of 2016 (2) dt.14-07-2016 2/2 pistol and three live cartridges were found in possession of coaccused Mithilesh Kumar. They also disclosed the name of his other associates as detailed in the F.I.R.

Learned counsel for the petitioners submits that both the petitioners have no criminal antecedent and are in custody since 24.05.2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City in connection with Didarganj P.S. Case No. 116 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioners, who will file an affidavit showing their relation with the petitioners.
