The petitioner apprehends his arrest in Cheria Bariarpur P.S. Case No. 6 of 2016 registered under Section 387 and other sections of the Indian Penal Code.
The learned counsel for the petitioner submits that though the petitioner is named in the F.I.R., but no specific allegation has been made against him and similarly situated co-accused Bijlee Mahton, Pawan Sahni and Manoj Sahni have already been granted anticipatory bail vide order dated 11.8.2016 passed in Cr. Misc. No. 31340 of 2016 and vide order dated 23.11.2016 passed in Cr. Misc. No. 43681 of 2016 and the case of the petitioner stands on same footing.
Considering the facts and circumstances and the fact that similarly situated co-accused persons have already been granted
Patna High Court Cr.Misc. No.4065 of 2017 (3) dt.08-03-2017 anticipatory bail, the above named petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Cheria Bariarpur P.S. Case No. 6 of 2016, subject to conditions laid down under Section 438(2) Cr. P.C.
