JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Galgalia P.S. Case No. 38 of 2017 for offences under Sections 379, 411, 413 and 34 of the Indian Penal Code.

Considering the fact that the petitioner has criminal antecedents, the Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The application is rejected. However, in the event the petitioner surrenders before the court below and seeks regular bail, the court below shall consider and dispose of the same on its own merits on the same day without being prejudiced by the order of rejection of this application.
