The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(a) of the Excise Act. From manufacturing unit operated by the petitioner 50 litres of illicit Mahua liquor and manufacturing equipments were recovered.

It is submitted by learned counsel for the petitioner that there is nothing on the record to suggest that the place of seizure was being operated by the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.38231 of 2015 (2) dt.22-09-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Hisua P.S. Case No. 89 of 2015 pending in the court of learned Chief Judicial Magistrate, Nawada.

With the aforesaid observation, this application is disposed of.
