JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek anticipatory bail in a case registered for the offences punishable under Sections 341,323,447,354 and 504/34 of the Indian Penal Code.

From the First Information Report, it appears that an altercation had taken place between the parties as their children were fighting to each other.

Learned counsel for the petitioners submits that over petty dispute, the alleged occurrence has taken place and the prosecution case is exaggerated version of what actually happened on the date of occurrence.

No.42160 of 2014 (2) dt.16-04-2015 Keeping in view the submission made on behalf of the petitioners and in view of the fact that the petitioners have no criminal antecedent, let petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishding bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Sahiyara P.S. case No. 96 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
