The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 18 litres Nepali Saufi wine was recovered from the possession of the petitioner. It is further contended that petitioner has falsely been implicated in this case as the real culprit manged to escape from the spot and he has been made a scapegoat. Petitioner claims that two more F.I.Rs. have been lodged against him but not under the Excise Act. Petitioner further claims that he is in custody since 19.08.2018.

No.59270 of 2018(2) dt.06-10-2018 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C2-433 of 2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
