Petitioner seeks bail in connection with Special (Excise) Case No. 417 of 2018 arising out of Bihra P.S. Case No. 169 of 2018 for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel, is that ten liters of country made liquor was seized from the motorcycle of the petitioner tied in two gallon which he was driving.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has been falsely implicated in the aforesaid case. He submits that he is

Patna High Court Cr.Misc. No.59000 of 2018 (2) dt.28-09-2018 2/2 in custody since 12.08.2018 and has been punished enough. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Saharsa in connection with Special (Excise) Case No. 417 of 2018 arising out of Bihra P.S. Case No. 169 of 2018.
