The petitioner seeks bail in a case registered under Sections 341, 323, 307, 325, 379, 506/34 of the Indian Penal Code.

The prosecution case in brief is that while the informant was sleeping in his house, the petitioner came there and gave Dabiya blow to the informant, as a result of which, the informant sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-01-2019. Charge sheet has already been submitted. There is case and counter case between

Patna High Court CR. MISC. No.18199 of 2019(3) dt.14-05-2019 2/2 the parties. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar, learned Judicial Magistrate-Ist Class, Sitamarhi in connection with Parihar P.S.
