JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 386 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, one Diwakar Kumar Sah was arrested and made his confessional statement disclosing this fact that he managed the paper in the name of one Sumit Roy and activated the Sim through which the demand of rangdari had been made. The aforesaid Diwakar Kumar Sah disclosed that this petitioner was also involved in the present crime. Thereafter, the petitioner was arrested and from his possession, the cover of Sim was recovered.

No.36301 of 2016 (2) dt.23-08-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Araria in connection with Forbisganj P.S. Case No.233 of 2016.
