The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 302, of the Indian Penal Code read with section 27 of the Arms Act.

The prosecution case in short is that the accused persons, variously armed, killed the brother of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.9.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner is said to be order giver. The main allegation is against the co-accused Nikhil. No assault is alleged to have been made by the petitioner upon the deceased.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Danapur, Patna in connection with Danapur P.S.
