The petitioner seeks bail in a case registered for offences under Sections 394 and 411 of the Indian Penal Code and Sections 37 (a)(b) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, the petitioner along with another person was apprehended in inebriated condition along with Rs. 1700/- which was claimed to be snatched from the informant. It is contended that the petitioner is a labourer and nothing has been recovered from his conscious possession. It is contended that the petitioner has no criminal

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Gardanibagh P.S. Case No. 281 of 2018 (Special Case No. 6468 of 2018) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
