This application for grant of regular bail arises out of Sakurabad P.S. Case No.12 of 2025 registered for the offence punishable under sections 103(1), 238 and 3(5) of the B.N.S., 2023.

As per the F.I.R., the daughter of the informant (deceased) was married with co-accused Manish Kumar and after marriage one girl child was born to the deceased. Subsequently, the deceased was being tortured by the accused persons and said Manish Kumar also performed second marriage.

The petitioner is the mother-in-law of the deceased. It is alleged that she along with other accused persons
Patna High Court CR. MISC. No.20116 of 2025(3) dt.12-05-2025 2/2 have killed the deceased. Earlier also, a case i.e. Shakurabad P.S. Case No.223 of 2024 under section 82(1), 85, 3(5) of the B.N.S., 2023 and under section 3/4 of the Dowry Prohibition Act was registered against the petitioner.

It has been submitted by learned counsel for the petitioner that on the way to hospital the deceased died because she had contracted cold.

There is no material to show that the deceased died due to illness whereas, during investigation materials have come that the dead body was cremated without information to the other side. The petitioner is in custody since 20.01.2025.

Considering the fact that the petitioner is the mother-in-law of the deceased and there is specific allegation against her that she has tortured and killed the deceased, I am not inclined to grant the petitioner privilege of regular bail.
