Petitioner is languishing in judicial custody since 02.06.2018 in connection with Alamganj P.S. Case No. 282 of 2018 for offences punishable under Sections 379, 511 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while he had gone to visit his father-in-law in the motorcycle and while coming out he found the petitioner sitting on his motorcycle and trying to open the lock of the motorcycle on which he was caught and disclosed his name.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and that no
Patna High Court Cr.Misc. No.58996 of 2018 (2) dt.28-09-2018 2/2 overt act has been committed. Allegations are false and it is only on suspicion that the petitioner has been made accused. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Alamganj P.S. Case No. 282 of 2018.
