JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 12-08-2015 The present application has been filed for modification of order dated 22.06.2011 passed in Cr. Misc. No. 11457 of 2011, whereby the petitioner was granted provisional anticipatory bail for nine months in connection with Tajpur (Waini) P.S. Case No. 438 of 2010 registered for the offences punishable under Sections 420, 468 and 469 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Samastipur.

The petitioner was granted provisional anticipatory bail on the undertaking that the petitioner is ready to deposit the cheque amount of Rs.2,00,000/- (Two lakhs) before the learned court below within a period of nine months but the same has not been deposited, hence, the prayer has been made for

Patna High Court Cr.Misc. No.42026 of 2014 (02) dt.12-08-2015 2/2 extending the period of deposit.

Since the present modification application has been filed on 10.10.2014 much after the lapse of period of provisional anticipatory bail, this Court is not inclined to entertain the present modification application.

Accordingly, this modification application is disposed of.

The present order will not preclude the learned court below to consider the prayer for regular bail of the petitioner, if the petitioner deposits Rs.2,00,000/- (Two lakhs). (Dinesh Kumar Singh, J) DKS/- U T
