JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,467,468,471 and 120B of the Indian Penal Code.
The prosecution case is that the accused persons under a conspiracy manufactured a forged rent deed dated 1.7.2010 with regard to the shop in order to grab the same. The alleged forged rent deed was filed in the court of the DCLR in Case No. 62 of 2013.
It is submitted by the learned counsel for the petitioner that at earlier point of time the petitioner side lodged Ghoghardiha P.S. Case No. 22 of 2011 levelling accusation under sections 448,341,323,354,379,427 and 420/34 IPC and Ghoghardiha P.S. Case No. 56 of 2011 registered with accusation under sections
Patna High Court Cr.Misc. No.37053 of 2015 (2) dt.14-09-2015 2/2 341,323,324,354,379,448 and 501/34 IPC against the informant side though the informant has also filed Title Suit No. 6 of 2011 against the petitioner.
Considering the nature of accusation in the background of cases lodged by the petitioner side at earlier point of time, title suit being pending and the petitioner having no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jhanjharpur in connection with Phulparas P.S. Case No.255 of 2013/G.R. No. 1488 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
