JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The name of the petitioner appears to have been surfaced on the basis of confessional statement of co-accused and thereafter the petitioner was arrested and remanded in the present case on 18.03.2016. The petitioner was put on Test Identification Parade but the informant failed to identify the petitioner. Petitioner does have criminal antecedent of two cases but in the present case, neither he is named nor anything has been recovered from his conscious possession and apart from this, he has not been identified in Test Identification Parade. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Muffasil P.S. Case No. 22 of 2016.
