09-01-2017 Heard Sri Binod Kumar Sinha, learned counsel for the petitioner and Sri Manish Kumar, learned A.C. to Addl. Advocate General - 6.
The present petition has been filed with a prayer to restore C.W.J.C. No. 11937 of 2007, which stood dismissed on 27-03-2014, due to non-prosecution.
Learned counsel for the petitioner submits that in the earlier writ petition, after obtaining 'No Objection', he had filed vakalatnama, but since his name was not appearing in the daily cause list, he missed to mark the case.
On perusal of the record of C.W.J.C. No. 11937 of
Patna High Court MJC No.1982 of 2015 (2) dt.09-01-2017 2/2 2007, it is evident that there was no fresh vakalatnama. In view of facts and circumstances, the Court is not persuaded with the plea taken by learned counsel for the petitioner.
I do not find any ground to restore the writ petition. Dismissed.
