The petitioners seek anticipatory bail in a case instituted for the offence under Sections 363 and 366/34 of the Indian Penal Code.
It is alleged that minor daughter of informant Anupriya Kumari aged about 16 years has been kidnapped by Oshi Alam, Abulesh Mian and his wife. It is further alleged that these petitioners have also helped them in kidnapping the daughter of the informant.
In this manner, from the written report itself, there is
Patna High Court Cr.Misc. No.3095 of 2017 (2) dt.31-01-2017 2/2 no allegation of any specific overt act against the petitioners. It is merely alleged that they helped the main accused. Considering the aforesaid facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Madhuban P.S. Case No. 192 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
