2. The petitioner seeks regular bail in connection with Hajipur Sadar P.S. Case No. 261 of 2024 registered for the offence under Sections 363, 366(A) of the Indian Penal Code and Section 4/6 of the POCSO Act.
3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 13.01.2025.
5. Learned A.P.P. has vehemently opposed the prayer
Patna High Court CR. MISC. No.21425 of 2025(2) dt.23-04-2025 2/2 for bail.
6. From the statement of the victim girl it appears that she had fled away with the petitioner on her own.
7. Considering the statement of the victim girl, this application for regular bail is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions JudgeVI-cum-Special Judge, POCSO, Vaishali at Hajipur/concerned Court below in connection with Hajipur Sadar P.S. Case No. 261 of 2024.
9. The application for bail stands allowed.
