The petitioner apprehends her arrest in Jogbani(Bathnaha) P.S. Case No. 74 of 2016 instituted for the offence under Section (s) 272, 273 of the Indian Penal Code and Section 47 of the Excise Act.
It has been submitted that name of this petitioner has been disclosed by co-accused Md. Sumar who was apprehended on the spot. On search, Nepali illicit liquor as mentioned in the written report was recovered from his possession.
In this manner, the petitioner was not caught on the spot nor there is recovery of any incriminating articles from
Patna High Court Cr.Misc. No.9262 of 2017 (2) dt.01-03-2017 2/2 the possession of the petitioner.
It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Jogbani(Bathnaha) P.S. Case No. 74 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Araria, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
